Linmar Scaffolding Ltd. recently accepted violation of regulation 8 (b) of the Work at Height Regulations 2005 before the Abergavenny Magistrates’ Court, after a structure they had constructed collapsed in June 2006.
The incident took place on the Western Industrial Estate in Caerphilly, which led to the Cardiff-based company being fined 1,800 pounds by the court this September. It was also asked to pay an additional amount of 5,400 pounds as costs. The workers of the next shift were scheduled to arrive at the site just 20 minutes after the collapse occurred, but luckily no one was harmed during the incident.
The Health and Safety Executive (HSE) has circulated warnings to scaffolding companies to secure their structures properly and to adhere to safety standards to prevent any such untoward incidents from occurring again.
HSE construction Inspector Dean Baker said that the scaffolding had not been correctly attached to the building, which is the main requisite for such a construction. He said the company should have been more responsible as they had always been engaged in constructing scaffoldings. Baker disclosed that the structure remained for only 11 days after it was put up, which means that it could have collapsed anytime, even while workers had been using it. He also drew attention to the recordings from the CCTV cameras that showed people walking nearby just two minutes before the structure fell. The inspector added that it was quite fortunate for workers and the company that no one was hurt.

HSE, in its ‘myth of the month’ series, has made an effort to clear its stand on the flip flops at workplace issue, by stating that it has never restricted people from wearing them to office. In a study conducted by HSE, a majority of people said that they believed that the HSE had put a restriction on wearing sandals to office and restrained kids from playing with conkers.
When asked about these myths, the HSE Chairperson, Judith Hackitt replied that they were baseless and bizarre. She further explained that there has been no prohibition on wearing flip flops or sandals to office especially during summers when it’s natural for people to wear them to remain cool.
However, about 30 % of workplace accidents are due to people losing balance or falling due to wrong type of footwear. She stated that there are workplaces that cannot be kept dry and clean all the time and in such places, it is prudent to wear something that has a firm sole and has a perfect fit.

In yet another incident of non-compliance with health and safety laws, Millennium Inorganic Chemicals Ltd, a chemical company, was fined £40,000 by the Grimsby Magistrates Court on April 3, 2009. The court also asked the company to pay £25,000 as costs. The judgement comes after an incident in 2006, which caused toxic and corrosive vapour to escape, thus leading to the breach of Section 2(1) of the Health and Safety at Work etc Act 1974.
The incident took place on October 29, 2006, when about 86 litres of titanium tetrachloride (TiCl4) was exposed to the atmospheric moisture during a regular vessel draining procedure. TiCl4 is an intermediate compound, which is produced during the manufacture of titanium dioxide.
Titanium dioxide is used in the manufacture of several products like plastic bags, components for the aerospace industry, and colouration for white paint. When TiCl4 encounters moisture, it becomes corrosive and poisonous. The situation would have become worse if an operator had not closed the valve in time and stopped a large enough amount of liquid from escaping.
After the decision of the court, the HSE has issued a warning to the entire chemical industry, urging them to understand the importance of safety and carefully implement the same at their sites.
Mike Nind, the HSE investigating officer, remarked that the accident could have been lethal if not for the presence of mind of the operator who stopped the leak and prevented a major mishap. The liquid could have endangered the lives of the inhabitants close to the site. The investigation report also showed that the company was not conducting sufficient risk assessments, and demonstrated a lack of proper supervision and safety measures. The incident would not have occurred if the company had complied with safety guidelines.
